The Court Appeal has nullified the election of Nansana Municipality MP Wakayima Musoke Nsereko and declared NRM’s Robert Ssebunya as the validly elected MP of area.
The 3 Justice including the Out-going DCJ Steven Kavuma, Cheborion Barishaki and Hellen Obura nullified Wakayima Musoke’s victory on grounds that he is not a registered voter of Nansana Municipality as his name does not appear anywhere in the voter’s register.
According to the evidence on record, the nominated candidate was Wakayima Musoke Nsereko whereas the Voter’s register and National I’D bear the name Musoke Hannington Nsereko.
The justices have ruled that therefore Wakayima Musoke Nsereko was nominated in error to participate in this election for which he was also unlawfully declared as winner.
The court has further ruled that the discrepancies in Wakayima Musoke’s names is an indication that he also lacks the minimum qualification to hold the post of an MP.
Wakayima Musoke has been ordered to pay Ssebunya costs of the petition he successfully filed against him in High court and for this appeal.
